These Terms govern all products, packages, memberships, and recruiting services purchased from Committed Sports Network. By purchasing, enrolling, creating an account, or using the Services, the Client agrees to these Terms and any package-specific terms shown at checkout or in an order confirmation.
These Terms of Service (the “Terms”) are between Committed Sports Network (“CSN,” “Provider,” “we,” “us,” or “our”), a division of Sparber University LLC, 21 Hickory Ln, Lincroft, New Jersey 07738, and the individual purchasing or using the Services (“Client”). If the Services are purchased for a minor athlete, the parent or legal guardian purchasing the Services is the Client and accepts these Terms on the athlete’s behalf.
The athlete receiving the Services is referred to as the “Player.” The specific package, tier, membership, duration, pricing, payment schedule, and deliverables selected by the Client at checkout or in an order confirmation are incorporated into these Terms by reference.
Beginning on the applicable purchase or activation date, CSN will provide the Services included in the Client’s selected package. Depending on the package purchased, the Services may include any or all of the following:
The exact scope, duration, frequency, and deliverables of the Services are determined by the package, tier, membership, checkout page, order confirmation, or other written purchase terms applicable to the Client.
Where an offer guarantee applies to the purchased Services, a “Formal Committable Offer” means a formal opportunity from a college baseball program that:
Where the applicable package states that CSN works with the Player until the Player is fully committed, CSN will continue providing the included recruiting support subject to these Terms and the purchased package.
CSN does not require the Client or Player to surrender ownership or control of any X (formerly Twitter) account or other personal social-media account. CSN will not require the Client or Player to provide an X password, transfer account credentials, or give CSN ongoing control of the account.
If CSN provides X/social-media strategy, suggested posts, direct-message templates, video assets, or platform tools, the Client or Player remains responsible for reviewing and initiating any post, direct message, connection, follow, or other activity from the Client’s account unless the parties separately agree in writing to a specific limited authorization.
Nothing in these Terms transfers ownership of the Client’s social-media account, username, followers, content, or login credentials to CSN.
The Client authorizes CSN to prepare and, where included in the purchased package, send recruiting communications on the Player’s behalf through CSN-controlled or otherwise authorized channels, including email and text communications, as though the communication were being sent for the Player’s recruiting purposes. This authorization is intended to support consistent, professional, and effective communication with college coaches.
This authorization does not give CSN permission to take over, control, or independently operate the Client’s X account or other personal social-media account.
If the purchased package includes CSN’s offer guarantee, CSN guarantees that it will obtain for the Player a college baseball offer from a school the Player would like to attend, subject to the definition in Section 3 and the terms of the applicable package.
The Player will provide CSN with a list of schools the Player would like to attend or will work with CSN to create a mutually agreed target-school list. If the applicable guarantee is not satisfied and CSN does not obtain an offer from a school on that agreed list, the Client is entitled to the refund stated in the applicable package terms.
If the Player is injured, medical forms and/or a doctor’s note may be required to document the injury and may be reviewed by CSN’s designated medical contact or representative as reasonably necessary to evaluate the Player’s ability to continue participating in the Services.
If the Player voluntarily decides that he no longer wishes to pursue baseball, the Client may contact CSN to discuss whether a partial refund is appropriate under the circumstances. Any such partial refund is not automatic unless expressly stated in the purchased package terms.
Pricing, payment terms, billing schedule, subscription or installment terms, and any package-specific obligations are those disclosed to the Client at checkout, on the applicable order form, invoice, or written order confirmation. Those purchase terms are incorporated into these Terms by reference.
Except where a specific refund right or guarantee applies, purchasing a package does not create any additional refund right beyond the written terms provided for that purchase.
Before initiating a refund demand, payment reversal, or chargeback, the Client agrees to first notify CSN in writing and participate in good-faith discussions regarding the issue.
If the Client initiates a payment dispute or chargeback without prior written communication to CSN, CSN may suspend Services while the dispute is pending. Nothing in this Section waives any right the Client may have under applicable law or the rules of the Client’s payment provider.
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles. To the extent a dispute is eligible for small-claims jurisdiction, the parties agree that it may be brought in the Small Claims Court serving Monmouth County, New Jersey. Any recovery of legal or administrative costs is subject to applicable law and any order of the court or tribunal with jurisdiction.
The Client is responsible for providing accurate contact, Player, academic, athletic, and recruiting information needed to deliver the Services. The Client is also responsible for safeguarding login credentials for any CSN platform account and for promptly notifying CSN of suspected unauthorized access.
CSN retains ownership of its proprietary training materials, recruiting frameworks, templates, software, platform content, processes, and other materials made available as part of the Services, except for Client-owned materials. The Client receives a limited, personal, non-transferable right to use CSN materials for the Player’s own recruiting and development purposes during the applicable service period.
The Client retains ownership of Player-created footage, photographs, account credentials, and other Client-provided materials. The Client authorizes CSN to use such materials only as reasonably necessary to perform the purchased Services, unless a separate written media or promotional authorization provides otherwise.
These Terms do not create an employment relationship, partnership, joint venture, or ownership interest between the Client and CSN. Except for the limited recruiting-communication authorization expressly stated in these Terms, CSN does not become the owner or general agent of the Player’s personal accounts or identity.
CSN may update these Terms from time to time for future purchases or continued use of ongoing platform or membership Services. Material changes will be reflected by an updated “Last Updated” date or other reasonable notice. Package-specific rights already purchased, including any written guarantee, remain subject to the purchase terms in effect for that transaction unless the Client agrees otherwise.
These Terms, together with the applicable checkout page, order form, invoice, package description, guarantee terms, and written order confirmation, constitute the agreement governing the Client’s purchase of Services from CSN and supersede prior verbal or written understandings concerning the same purchased Services. If a package-specific written term conflicts with these general Terms, the more specific written package term will control for that purchase.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. A failure by either party to enforce a provision on one occasion does not waive the right to enforce it later.
Questions, notices, refund requests, or dispute notices relating to these Terms should be submitted through CSN’s official support or contact channel provided on the CSN website, platform, invoice, or order confirmation.
